No offence committed u/sec 457 IPC as the door could be opened easily proving there was no ‘fastening’ of the door: Orissa HC

The appellant faced trial in the Court for offences punishable under sections 376/ 511, 354 and 457 of the Indian Penal Code. The learned trial Court found the appellant guilty of the offences charged and sentenced him to undergo rigorous imprisonment for three years and to pay a fine of Rs.100/-, in default, to undergo R.I. for one month for the offence under section 376/511 of Indian Penal Code, R.I. for one year and to pay a fine of Rs.100/-, in default, to undergo R.I. for one month for the offence under section 457 of Indian Penal Code and both the sentences were directed to run concurrently. No separate sentence was awarded for the offence under section 354 of the Indian Penal Code.
